If you submitted a breath test or allegedly refused a chemical test you must request a hearing at any DMV driver’s license office within 7 days of the date of notice indicated on your Express Consent Affidavit and Notice of Revocation. If you held a valid driver’s license at the time of the stop, the DMV representative will issue you a temporary permit to drive on up until the hearing, or 60 days, whichever occurs first. When you request the hearing the DMV representative will ask you if you want the police officer present at your DMV hearing. It’s probably best to contact an experienced DUI lawyer prior to going to DMV to determine the best course of action regarding the police officer’s presence at the DMV hearing.
DMV hearings for Boulder County cases are held in-person at the Boulder DMV office located at 2850 Iris Avenue, Suite F, Boulder, Colorado 80301. If you request the police officer’s presence at the time of the hearing request and thereafter the police officer does not show up for the hearing, you can likely get the DMV revocation proceeding dismissed on the grounds of the non-appearance.
