How to Fight a Pacing Speeding Ticket
Sometimes police officers in Denver and other cites in Colorado will use pacing as a method to clock a driver’s speed.
In order for the technique to work properly, the officer must keep a constant distance between his police cruiser or motorcycle and the driver’s car. Things that can impact an officer’s pacing technique include curves in the road, pacing for short distances, traffic signs and signals, lighting conditions, roadway interchanges, heavy traffic, busy intersections, and other factors on the road.
If an officer is pacing from further back, the pacing method becomes less accurate. The most accurate method results from an officer pacing immediately behind a driver’s vehicle for a reasonable distance.
There are various cross-examination techniques an experienced traffic lawyer can use to prove that the officer’s pacing method may not be as accurate as he claims. A good cross-examination in this area can assist the trier of fact in determining that the case has not been proven beyond a reasonable doubt.
