Careless/Reckless Driving

A charge of careless driving involves an allegation that a person drove a motor vehicle, bicycle, or motorized bicycle in a careless and imprudent manner. In Colorado, careless driving is a criminal misdemeanor traffic offense and is applicable to both driving on public roadways, as well as private property. If you are convicted of careless driving, four (4) points will be assessed against your driver’s license. Even if you hold an out-of-state driver’s license, your conviction will be reported to Colorado Division of Motor Vehicles and you will generate a Colorado driver history record through a computer-assigned personal identification number (p.i.n.)/tracking number. Your Colorado conviction may be reported to your home state through the Driver’s License Compact (DLC).

Penalties for careless driving depend upon which court your case is in. Your case may be prosecuted in county court or municipal court. If your case is being prosecuted in county court, the presumptive penalty ranges from a minimum ten (10) days in jail up to ninety (90 days), plus fines and court costs, and the possibility of probation. The penalty is typically more severe in municipal court, where the same violation can carry a possible penalty of up to one (1) year in jail and a fine of one thousand ($1,000) dollars, depending upon the court. Criminal restitution may also be assessed.
