Of that number, 1061 cases were charged as a DUI, meaning the police officer and the district attorney believed that the driver was substantially incapable of safely operating a motor vehicle. Only 16 cases were charged as DWAI, meaning that the police officer and the district attorney believed that the driver’s ability to drive was impaired even to the slightest degree.
The average BAC for all cases prosecuted in Larimer County in 2012 was .153, which is approximately three (3) times the “legal limit” for the presumptive range of DWAI and almost two (2) times the presumptive range for DUI in Colorado.
According to Colorado Statute, a driver is inferred to be impaired by alcohol if his BAC is at least .051, but less than .08. Conversely, if a driver’s BAC is .05 or less, there is a presumption that the driver is not under the influence of alcohol and not impaired by alcohol. And if the driver’s BAC is .08 or greater, there is a permissible inference that the driver was under the influence of alcohol. Unfortunately, there is a common misconception that the “legal limit” is .08, but in reality it is .051.
Larimer County prosecutes DUI offenses from two (2) separate courthouses, depending upon the geographic area of where the alleged offense occurred. The main courthouse is located in Fort Collins at 201 LaPorte Avenue in the Larimer County Justice Center. Other cases are handled in Loveland at the Loveland County Court, 810 East 10th Street, Loveland.
