Why hire a lawyer for your traffic violation?

In Colorado, many traffic violations carry a significant amount of points to be assessed against a person’s driver’s license. If a driver accumulates too many points, her license will be suspended. For those that rely upon their driver’s license, life without a license is typically unimaginable. Thus, it’s best to try to minimize or eliminate the impact that any traffic ticket may have upon a person’s driving record. Additionally, many traffic violations are criminal offenses and carry the possibility of jail time. Traffic offenses can also cause increased insurance premiums and a negative impact upon a person’s employment. If you’ve been charged with a traffic violation in Adams County, contact Adams County Traffic Lawyer Monte Robbins today to discuss your options: 303-355-5148.

How many points can I have on my license?

In Colorado, the number of points a person is permitted to have on his/her license without being suspended depends upon the person’s age (and occupation, if the person is a “chauffeur”). All drivers, regardless of age, are entitled to a point suspension hearing at the Colorado Department of Revenue Hearings Division if too many points are accumulated on a driver’s license.

Minor Under 18: If a driver is under 18, she will be suspended if she obtains 6 points in a 12 month period. The date of violation is what is utilized in calculating the 12 month period, not the date of the conviction in court. Further, a minor driver will be suspended for too many points if she reaches 7 points in a 24 month period. For the life of the license, a minor driver under 18 will be suspended if she has 7 points on her record prior to reaching age 18.

Minor 18-21: If a driver is between ages 18-21, he will be suspended if he obtains 9 points in a 12 month period or 12 points in a 24 month period. The time period is calculated by date of violation rather than date of conviction. Also, if a driver between ages 18-21 accumulates 14 total points for violations occurring after age 18, he will be suspended for too many points over the “life of the license”.

Adult Over 21 : If a driver is 21 years of age or older, she will be suspended if she accumulates 12 points over 12 months or 18 points over 24 months. Unlike a minor license under 18 or a minor license ages 18-21, there is no “life of license” suspension possible for adults aged 21 and older.

Chauffeur: If a chauffeur (Uber driver, Lyft driver, taxi driver, etc.) accumulates 16 points in 12 months or 24 points in 24 months, he will be suspended for accumulating too many points. These points must have occurred during the course of the chauffeur’s employment. Further, if a chauffeur obtains 28 points over 48 months, he will reach a points suspension.
